They differ from trade mark attorneys as they do not need to undertake accredited courses required for registration as a trade mark attorney. However, as lawyers, they need to have a recognised law degree and be admitted to practice at both state and federal levels.

A person can be both a trade mark lawyer and trade mark attorney if they are admitted to practise law and have undertaken the accredited courses required to be registered as a trade mark attorney in Australia.
