Actuate IP Group comprising of Actuate Patent Attorneys and Actuate Intellectual Property (‘the Group’) understand and are committed to protecting the personal and confidential information that we collect or hold on your behalf. Our Group is bound by and adheres to the National Privacy Principles outlined in the Privacy Act 1988 (Cth). We also comply with the Spam Act 2003. 1. Personal Information Collected During the course of your dealings with our Group, we may and only collect personal information necessary for us to conduct our services for you. The type of information we may collect includes your general contact details (names, address, telephone contact, email contact) or other specific types of information required as part of the work we conduct for you. We also collect information you provide by way of the Group’s website at www.actuateip.com.au, only when you knowingly provide it (for example contact forms) or you send us an email. We do not collect personal information as a result of the mere act of you visiting our website. We do monitor the traffic activity of our website but from this statistical information we cannot and will not reasonable ascertain your identity. We also collect statistical information arising from an email campaign manager system which tracks how and what actions you undertake when receiving our emails relating to marketing material and the like provided by the Group. 2. Use and Disclosure of Information Actuate IP Group only use information collected from you either for the purpose of carrying out the services we have been instructed by you to perform or relevant to your needs. Alternatively or in addition to, such information will only also be used by the Group to perform a function as legal and attorney service providers. Some of these functions may include using such information to send you marketing or legal information relevant to your needs or interest. We will provide you with the option at any time to opt out of receiving such information. We also disclose your personal information to third parties inc ases where they are retained by us to assist in the conduct of the services we are instructed to undertake by you or are relevant to you (for example barristers). In some cases we may be compelled by law to provide such information. 3. Access to Your Personal Information You are able to request and gain access to the personal information we hold about you arising from actions generally outlined in section 1 and 2 above. All requests are to be addressed to the Privacy Officer by email, fax or post at the contact details listed below. We may charge you for the provision of such information for a reasonable sum. You can change or update the personal information we hold about you by again contacting the Privacy Officer. We may refuse access to your personal information in certain circumstances in accordance with National Privacy Principles. If we refuse access we you provide you reasons as to why. 4. Security Actuate IP Group takes all reasonable steps to ensure your personal information as held by us remains secure both physically and electronically. We however cannot accept any responsibility for information transmitted by the Internet either to us or from us or any resulting unauthorised access. 5. Changes to Policy We may require from time to time make changes to this privacy policy and recommend you review this policy periodically. The revised version will be available on this website. 6.
